Second RegulationResearchConference
On 4 and 5 December 2023, the Chair hosted the second annual RegulationResearchConference as part of the "Regulatory Instruments in the Real World" research programme funded by the Volkswagen Foundation. The focus was on the question of personalized law. The keynote speech was given by Prof Omri Ben-Shahar from the University of Chicago. A conference report can be found here.
New Publication: Crisis Management and Contract Law
Prof. Hellgardt gave a paper on "Crisis Management and Contract Law" at the last Civil Law Teachers' Conference, which has now been published in an expanded version in AcP 223 (2023), 234-343 (in German). The paper addresses the question of how unforeseen crises, and especially the equally unforeseeable state responses to these crises, affect existing contracts and how this tension is to be resolved. Prof. Hellgardt addresses this question for past crises (Corona pandemic), present crises (Ukraine war) and future crises (climate crisis). In doing so, he shows that the adaptation of contracts affected by state crisis management measures is not only about the interests of the parties involved, but also about the public interest in reducing economic and liberty losses as much as possible and allocating them in a socially adequate way.
